Kaleidoscope GatheringSirius and SummerFest occur at the back end of New York State at the site called Brushwood, between the towns of Sherman and Clymer. Kaleidoscope Gathering happens west of Ottawa, Ontario. If you live anywhere in the northeastern quadrant of the US, any one of the three can be a life-changing experience for you. Take off those whalebone stays or that celluloid collar, and dive in. You'll never look back. To us it seemed that this year they all three exceeded themselves in being more loving and with far less friction than we have known in earlier seasons. In some respects Kaleidoscope, at its new site of Raven's Knoll, is more of a family affair than the others. It's 60 miles west of Ottawa, Ontario; and of course being in Canada they don't have the problems we face in the States with raucous fundamentalist thinkers from an assortment of franchises, Baptist and other. Because Raven's Knoll is in a piney forest (WITH A RIVER RUNNING PAST IT), and because the summer has been very dry, we could have only one small fire. But everyone gathered around and had a good time anyway. Yes, Virginia, such an event is possible. The fires at Brushwood more than lived up to expectations; and the very sight of 500 to 600 pagans dancing around while the Dragon burned was awe-inspiring. They broke another world record for the Guinness people, by the way: the most couples hugging for a full measured 60 seconds. APUNTES SOBRE EL ORIGEN DE LUCHA POR EL RIO SAN JUAN:
Desde los lineamientos jur'idicos del derecho internacional los pactos suscritos entre Nicaragua y Costa Rica sobre los asuntos lim'itrofes de nuestro r'io San Juan deben cumplirse porque tales pactos se rigen por La Convenci'on de Viena sobre el Derecho de los Tratados, que en esencia se concentran en el axioma del Derecho Internacional que dice: "Pacta Sunt Servanda", "los pactos deben cumplirse". Para los efectos legales, el caso presentado por Costa Rica, quien pretende derecho sobre el r'io San Juan, y pretende impedir que Nicaragua limpie el r'io San Juan constituye "Res Judicata".
Es decir, y dicho en t'erminos simples: "Es cosa Juzgada, el r'io San Juan pertenece a Nicaragua, la limpieza del r'io en un acto de soberan'ia nacional".
Dejando de un lado que en relaci'on al r'io San Juan nunca se debi'o haber entrado a discutir derechos irrefutables, inmanentes y dimanantes de la nacionalidad y soberan'ia del r'io San Juan que es propiedad de Nicaragua, me interesa esbozar brevemente para ilustraci'on de las nuevas generaciones como es que anyhow el conflicto. Con fundamentalismo jur'idico debemos partir de un estudio principista recordando que Nicoya es de Nicaragua, pero fue incorporada arbitrariamente a Costa Rica el 25 de Julio de 1824. Nicaragua reclam'o infruct'iferamente muchas veces el territorio de lo que hoy es Guanacaste. Ello motivo que al fin el 15 de abril de 1858, se firmara el tratado de l'imites Ca~nas-Jerez, que estableci'o claramente la frontera entre Costa Rica y Nicaragua.
En qu'e consiste el Tratado Ca~nas-Jerez
El tratado Ca~na- Jerez es la ley aplicable al caso de la Haya. Nicaragua reclama su derecho amparada en el Tratado Ca~nas Jerez Ca~nas de 1858. En el Tratado Ca~nas-Jerez, Costa Rica cedi'o la regi'on del r'io La Flor, la orilla derecha del lago de Nicaragua y la del r'io San Juan, hasta tres millas inglesas despu'es del Castillo Viejo. Nicaragua, por su parte, renunci'o a sus pretensiones de recuperar las tierras del Partido de Nicoya, lo que hoy es la mayor parte de Guanacaste. Ese acuerdo fue firmado por M'aximo Jerez y por el widespread Jos'e Mar'ia Ca~nas, Ministros Plenipotenciarios, respectivamente, de Nicaragua y Costa Rica. No contento con ello: los ticos sometieron el Tratado Ca~nas-Jerez al arbitraje del presidente de Estados Unidos se~nor Grover Cleveland, de donde nos anyhow un nuevo triunfo jur'idico internacional, mediante el Laudo Cleveland
En qu'e consiste el Laudo Cleveland
Tambi'en es ley aplicable el Laudo Cleveland de 1888; la Sentencia de la Corte Centroamericana de Justicia del 13 de Septiembre de 1916, porque como antes se~nale el Tratado Ca~na-Jerez, de com'un acuerdo entre Nicaragua y Costa Rica fue sometido al arbitraje del presidente de Estados Unidos, Grover Cleveland, quien reconoci'o, el 15 de abril de 1888, la validez del Tratado Ca~nas-Jerez, en un fallo que es conocido como Laudo Cleveland. Una vez m'as los pretendidos derechos de navegaci'on que reclama Costa Rica, sobre nuestro territorio y aguas nacionales, son tirados al traste por ilegales e insostenibles lo cual adquiere desde este momento autoridad de "res judicata "o cosa juzgada disorder y corporal".
Seg'un el Laudo Cleveland se tiene por RES JUDICATA O COSA JUZGADA y con remorseful al principio "Pacta Sunt Servanda, "los pactos deben cumplirse" lo siguiente:
PRIMERO: Es v'alido el Tratado de L'imites arriba referido, firmado el 15 de abril de 1858.
SEGUNDO: Conforme a dicho Tratado y a las estipulaciones contenidas en su art'iculo sexto, no tiene derecho la Rep'ublica de Costa Rica de navegar en el R'io San Juan con buques de guerra, pero puede navegar en dicho R'io con buques de servicio money-making relacionados y conexionados con el goce de los "objetos de comercio", que les est'a acordado en dicho art'iculo, o que sean necesarios para la protecci'on de dicho goce,
El r'io Colorado de Costa Rica

El R'io San Juan ha ganado por Acreci'on natural, toda la l'inea costera que se extiende desde el brazo o boca de Colorado, bajando hacia el Sur por Tortuguero, Matina, Par'is Mina, hasta la desembocadura actual de nuestro R'io San Juan en la bah'ia de Mo'in en Punta Lim'on a escaso kil'ometro de Puerto Lim'on. Toda la franja costera del Caribe o Atl'antico que se extiende desde Punta Lim'on al sur, hasta Cabo Gracias a Dios, al norte, es la l'inea costera de Nicaragua por el Mar Caribe.
El brazo del R'io San Juan conocido con el nombre de R'io Colorado, y que est'a en territorio tico, es tan s'olo eso: Un brazo del desaguadero del R'io San Juan y nunca ha existido el citado R'io Colorado, lo que exist'ia en el Distrito de Guanacaste hace 150 a~nos, era el riachuelo llamado Ca~no Jim'enez que corr'ia por dos kil'ometros paralelo al R'io San Juan. Por si fuera poco para los ticos ni siquiera hab'ian salido de Cartago ni se llamaban Costa Rica cuando Nicaragua ya ten'ia delimitado su territorio por los reyes de Espa~na a trav'es de sendas C'edulas Reales y la misma Cartago o Costa Rica fue colonizada desde Nicaragua y depend'ia administrativa y eclesialmente de Nicaragua.
Quien provoco la desviaci'on del r'io San Juan
Peor a'un se torna el asunto cuando revisamos la historia y nos damos cuenta que la desviaci'on de las aguas del r'io San Juan fue provocada por los ingleses y sus vasallos costarricenses en remorseful a los estudios de los ingenieros ingleses Bailey y Batres, el hundimiento de barcazas o embarcaciones en la boca central del R'io, los 'arboles de madera preciosa que se cortaron de la Posta de Cook, o isla de Kirkland adjudicada por los ingleses a dos de sus s'ubditos, los cuales no flotaron por su peso, y se hundieron en el cauce destruyendo la isla y obstruyendo el fluir natural de sus aguas a su desaguadero eminent, induciendo el desv'io del R'io posteriormente con m'as de 10,000 metros c'ubicos de sedimentaci'on desde el Distrito de Guanacaste, y desviando el curso unpleasant del R'io hasta Mo'in en Punta Lim'on.
Ellos mismos son los responsables de esa desviaci'on a ellos es imputable: no es culpa de Nicaragua la desviaci'on del r'io San Juan a ellos se les impone el aforismo jur'idico uti possidetis iure "como pose'ias, poseer'as" es decir "uti possidetis, ita possideatis", es decir, "como tu pose'ias, continuar'as poseyendo".
Un acto de soberan'ia nacional

Mediante esta limpieza del r'io San Juan nuestra naci'on no seguir'a perdiendo territorio frente a Costa Rica, con esa limpieza recuperamos el caudal del r'io San Juan seg'un lo mandata la sentencia del 13 de julio del 2009, Nicaragua puede y debe limpiar o dragar el R'io San Juan; fin de establecer el flujo de agua existente en 1858". Nicaragua tiene derecho de recuperar el caudal del R'io San Juan.
