El tratado Ca~na- Jerez es la ley aplicable al caso de la Haya. Nicaragua reclama su derecho amparada en el Tratado Ca~nas Jerez Ca~nas de 1858. En el Tratado Ca~nas-Jerez, Costa Rica cedi'o la regi'on del r'io La Flor, la orilla derecha del lago de Nicaragua y la del r'io San Juan, hasta tres millas inglesas despu'es del Castillo Viejo. Nicaragua, por su parte, renunci'o a sus pretensiones de recuperar las tierras del Partido de Nicoya, lo que hoy es la mayor parte de Guanacaste. Ese acuerdo fue firmado por M'aximo Jerez y por el widespread Jos'e Mar'ia Ca~nas, Ministros Plenipotenciarios, respectivamente, de Nicaragua y Costa Rica.
